Terms of Service & Data Handling

These Terms of Service (“Terms”) govern your access to and use of RadTypist (the “Service”), operated by Vixo Digital Pty Ltd (“RadTypist”, “we”, “us”), a company incorporated in Victoria, Australia. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What RadTypist is
RadTypist converts a dictation recording into a formatted radiology report. It is a drafting assistant: every report must be reviewed and signed off by a qualified radiologist before clinical use. RadTypist does not practise medicine, does not provide medical advice, and is not a medical device.
2. Eligibility & authority
The Service is intended for radiologists and other qualified healthcare professionals, and for organisations that employ them, for professional use. By using the Service you confirm that you are at least 18 years old and that, where you accept these Terms on behalf of an organisation, you have authority to bind that organisation.
3. Your account
Sign-in is passwordless: we email a one-time link to your address. You are responsible for keeping access to your email account secure and for all activity under your account. Tell us promptly at support@radtypist.com if you suspect unauthorised access.
4. Acceptable use
You agree not to:
- upload patient-identifying information (see section 5);
- use the Service unlawfully, or in breach of any professional, privacy, or healthcare regulation that applies to you;
- attempt to reverse-engineer, scrape, resell, or build a competing service from the Service;
- probe, overload, or circumvent quotas, rate limits, or security controls; or
- upload malware or content you have no right to process.
5. No patient identifiers
Do not include patient-identifying information (name, date of birth, medical record number, address, or similar) in your dictation. RadTypist is designed for de-identified clinical dictation only. You are solely responsible for ensuring that recordings and reports contain no patient identifiers, and you accept this data-handling approach as is.
6. AI accuracy & clinical responsibility
Reports are generated by automated speech-to-text and language models. Output may contain errors, omissions, or mis-transcriptions and must not be relied on without review. The reviewing radiologist is solely responsible for the accuracy, completeness, and clinical use of every report. RadTypist makes no diagnostic claim and accepts no clinical responsibility for reports produced through the Service.
7. Plans, billing & cancellation
- Plans. A free tier is available; paid plans (Starter, Plus, Pro) are billed monthly in advance through our third-party payment processor. Quotas reset at the start of each calendar month (UTC). Failed jobs do not consume quota.
- Auto-renewal. Paid subscriptions renew automatically each month until cancelled.
- Cancellation & refunds. You can cancel at any time. Your plan stays active until the end of the current paid period and then stops; we do not provide refunds for partial months or unused quota.
- Price & tax. Prices are exclusive of taxes unless stated; we may change prices on reasonable notice, effective from your next renewal.
8. Your content & ownership
As between you and RadTypist, you own your dictations and the reports generated from them. You grant us a limited licence to host and process your content solely to provide and improve the Service to you, including sending it to the sub-processors named in section 10. We do not sell your content, and we do not use it to train our own or third parties’ foundation models.
RadTypist, including its software, models, templates, and brand, remains our property. These Terms grant you no rights in it beyond use of the Service.
9. What we store, and for how long
- Recordings are stored only transiently and are deleted as soon as the report is generated.
- Reports (and their structured content, to allow editing) are stored in your account until you delete them or close your account.
- Data is encrypted in transit (TLS) and at rest, and scoped to your account.
- Access and erasure actions are recorded in an audit log.
10. Sub-processors & international transfer
To run the Service we rely on a small number of third-party providers, each processing your data only to perform its function:
- AI processing providers — convert your recording into a transcript and structure it into a report.
- A payment processor — handles billing (billing details only; never your clinical content).
- An email provider — delivers your sign-in links (your email address only; never your clinical content).
- Cloud hosting & storage — your reports are hosted and stored on cloud infrastructure located in Singapore (SG).
Our AI providers process content via their APIs and, under those API terms, do not use it to train their models. Some processing may occur outside your country. By using the Service you consent to this processing and transfer. Because you submit de-identified data only, no patient personal information is shared with these providers.
11. Deletion, retention & your choices
You can delete any individual report at any time, or close your account to erase all your reports and data. Where a retention window is configured, reports are automatically purged after it elapses. To request export or deletion, contact support@radtypist.com.
12. Warranties & disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and that the Service will be uninterrupted, error-free, or that any report will be accurate or complete.
Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (ACL) or other law that cannot lawfully be excluded. Where our liability for a failure to comply with a consumer guarantee can be limited, it is limited (at our option) to re-supplying the Service or paying the cost of re-supply.
13. Limitation of liability
To the maximum extent permitted by law (and subject to the Australian Consumer Law note above), RadTypist is not liable for any indirect, incidental, special, or consequential loss, or for loss of profits, data, goodwill, or any clinical decision or outcome arising from use of the Service. Our total aggregate liability arising out of or relating to the Service is limited to the greater of the fees you paid us in the three (3) months before the event giving rise to the claim, or AUD 100.
14. Indemnity
You agree to indemnify and hold RadTypist harmless from claims, losses, and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your inclusion of patient-identifying information in content you submit.
15. Suspension & termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (for example ownership, disclaimers, liability, and indemnity) continue to apply.
16. Changes to these Terms
We may update these Terms from time to time. The version and effective date appear at the top of this page. Material changes will be notified in-app or by email; continued use after a change takes effect means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You and RadTypist submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia, without affecting any mandatory rights you have under the Australian Consumer Law.
